Introduction
SelectPro Limited (NZ Company Number 9429053350060) (we, us, our) complies with the New Zealand Privacy Act 2020 (the Act) when dealing with personal information. Personal information is information about an identifiable individual (a natural person).
We also serve customers and users in Australia, Canada and the United States. Where they apply to you, we comply with the Australian Privacy Act 1988 (including the Australian Privacy Principles), Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws (including Quebec's Act respecting the protection of personal information in the private sector), and applicable United States federal and state privacy laws. Additional information for individuals in those countries is set out in the country-specific sections below.
This policy sets out how we will collect, use, disclose and protect your personal information when you visit our website, sign up for or use the SelectPro platform (SelectPro), or otherwise interact with us.
This policy does not limit or exclude any of your rights under the Act. If you wish to seek further information on the Act, see www.privacy.org.nz.
Changes to this Policy
We may change this policy by uploading a revised policy onto our website. The change will apply from the date that we upload the revised policy.

Who We Collect Your Personal Information From
We collect personal information about you from:
- you, when you provide that personal information to us, including via our website, when you register for or subscribe to SelectPro, when you contact us by telephone or email, when you participate in a sales or onboarding process, and when you use SelectPro or any related service; and
- third parties where you have authorised this or the information is publicly available (for example, business contact information from public registers, your employer, or the customer organisation that has issued you with access to SelectPro).
If possible, we will collect personal information from you directly.
Where we collect personal information about you from someone other than you (for example, from the customer organisation that has issued you with access to SelectPro, from your employer, or from a public register), we will take reasonable steps to make you aware that we have collected it, the fact that this policy applies to it, and the matters set out in this policy, unless an exception applies (for example, because you are already aware of those matters, the information is publicly available, or it is not reasonably practicable to notify you in the circumstances). Where a customer organisation issues you with access to SelectPro, we generally rely on that organisation to make you aware of this policy as part of your onboarding; if you have not been made aware of it, you can find it here at any time, or contact us at contact@selectpro.app.
How We Use Your Personal Information
We will use your personal information to:
- verify your identity and administer your access to SelectPro;
- provide SelectPro and any related services and products to you;
- communicate with you about your account, including service notifications, billing matters, and changes to our terms or policies;
- market our services and products to you, including by contacting you electronically (for example, by email), where you have not opted out;
- improve, develop and operate SelectPro and our other services and products;
- bill you and collect amounts owing to us, including authorising and processing electronic payments;
- respond to communications from you, including any complaint;
- conduct research and statistical analysis on an anonymised basis, including to generate aggregated data sets, benchmarks and insights derived from data submitted to or generated through SelectPro;
- protect and enforce our legal rights and interests, including defending any claim; and
- comply with our obligations under any applicable law and meet any other purpose authorised by you or by the Act.
Disclosing Your Personal Information
We may disclose your personal information to:
- another company within our corporate group;
- any business that supports our services and products, including any cloud hosting provider, infrastructure provider, payment processor, customer support tool, analytics provider, error-monitoring service, email service provider, or other person that hosts or maintains any underlying IT system or data centre we use to provide SelectPro and our website;
- third parties, on an aggregated and anonymised basis (for example, statistical insights and benchmarks derived from platform data that do not identify you);
- a person who can require us to supply your personal information (for example, a regulatory authority);
- any other person authorised by the Act or another law (for example, a law enforcement agency); and
- any other person authorised by you.
A business that supports our services and products may be located outside New Zealand. This may mean that your personal information is held and processed outside New Zealand. Where this occurs, we will take reasonable steps to ensure that your personal information receives a comparable level of protection to that required under the Act, in accordance with Information Privacy Principle 12.
We may also transfer your personal information in the case of a sale, merger, consolidation, liquidation, reorganisation or acquisition of our business.
Protecting Your Personal Information
We will take reasonable steps to keep your personal information safe from loss, unauthorised access, use, modification, disclosure or other misuse. These steps include access controls, encryption of data in transit, secure hosting environments, and internal policies governing how our personnel handle personal information.
Accessing and Correcting Your Personal Information
Subject to certain grounds for refusal set out in the Act, you have the right to access your readily retrievable personal information that we hold and to request a correction to your personal information. Before you exercise this right, we will need evidence to confirm that you are the individual to whom the personal information relates.
In respect of a request for correction, if we think the correction is reasonable and we are reasonably able to change the personal information, we will make the correction. If we do not make the correction, we will take reasonable steps to note on the personal information that you requested the correction.
If you want to exercise either of the above rights, email us at contact@selectpro.app. Your email should provide evidence of who you are and set out the details of your request (for example, the personal information you are requesting access to, or the correction you are requesting).
We may charge you our reasonable costs of providing copies of your personal information to you or correcting that information.
Depending on where you live, you may also have the right to ask us to delete your personal information, to provide it to you in a portable format, to restrict or object to certain uses of it, or to withdraw consent you have previously given. You can exercise any of these rights by emailing us at contact@selectpro.app. We will respond within the time required by applicable law (and in any case within 30 days unless we tell you we need longer). Where we hold personal information on behalf of a customer organisation that has issued you with access to SelectPro, we may need to refer your request to that organisation, as it controls how that information is used.
We will not treat you differently or deny you our services because you have exercised a privacy right.
Internet Use
While we take reasonable steps to maintain secure internet connections, if you provide us with personal information over the internet, the provision of that information is at your own risk.
If you follow a link on our website to another site, the owner of that site will have its own privacy policy relating to your personal information. We suggest you review that site's privacy policy before you provide personal information.
Where Your Personal Information Is Held
We are based in New Zealand, and some of the service providers we use to operate our website and SelectPro are located overseas. In particular, our website hosting, analytics, and email delivery providers process personal information in the United States, and our error-monitoring provider processes it in the European Union. This means that your personal information may be stored in, or accessed from, New Zealand, the United States, the European Union and other countries in which our providers operate.
While your personal information is outside the country in which you live, it may be subject to the laws of the country in which it is held and may be accessible to the courts, law enforcement and national security authorities of that country. We only disclose personal information to overseas providers who are bound by contractual obligations to protect it, and we take reasonable steps to ensure it receives a comparable level of protection to that required under the Act and, where applicable, the privacy laws of your country.
How Long We Keep Your Personal Information
We keep personal information only for as long as reasonably necessary for the purposes for which it was collected, to provide SelectPro to you or the customer organisation that issued you with access, to comply with our legal, tax and accounting obligations, and to establish, exercise or defend legal claims.
Account information is retained for the life of the relevant customer account and for a reasonable period afterwards. Customer data submitted to SelectPro is handled in accordance with our Master Service Agreement with the relevant customer, which provides for deletion after termination. Analytics data and session recordings are retained in accordance with our analytics provider's retention settings and then deleted. When personal information is no longer required, we delete or anonymise it.
Marketing Communications
We may send you marketing communications about our services and products by email where you have consented, or where we are otherwise permitted to do so by the law that applies to you (for example, because you have an existing business relationship with us). Every marketing email we send includes a working unsubscribe link, and you may opt out at any time by using that link or by emailing us at contact@selectpro.app. We will action opt-out requests promptly, and in any case within 10 business days. Service messages relating to your account (such as billing notices and changes to our terms) are not marketing communications and will continue to be sent while you hold an account.
Additional Information for Individuals in Australia
If you are in Australia, this section applies in addition to the rest of this policy. To the extent that the Australian Privacy Act 1988 (the Australian Act) applies to us, we handle your personal information in accordance with the Australian Privacy Principles (APPs).
- Overseas disclosure: as described above, we are likely to disclose your personal information to recipients located in New Zealand, the United States and the European Union.
- Sensitive information: we do not ask for sensitive information (as defined in the Australian Act). Please do not enter sensitive information into SelectPro unless it is necessary to use the service.
- Anonymity: where it is lawful and practicable, you may deal with us anonymously or under a pseudonym, for example when browsing our website or making a general enquiry. You will need to identify yourself to use SelectPro.
- Direct marketing: you may opt out of direct marketing at any time as described in the Marketing Communications section, and we comply with the Spam Act 2003 (Cth).
- Notifiable data breaches: if we experience a data breach that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner (OAIC) as required by the Australian Act.
- Complaints: you may complain to us as described in the Complaints section. If you are not satisfied with our response, you may complain to the OAIC at www.oaic.gov.au.
Additional Information for Individuals in Canada
If you are in Canada, this section applies in addition to the rest of this policy.
- Consent: we collect, use and disclose your personal information with your consent, which may be express or implied depending on the sensitivity of the information and your reasonable expectations, or as otherwise permitted or required by law. You may withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice, by contacting us. Withdrawing consent may mean we cannot continue to provide SelectPro to you.
- Accountability: we have designated a Privacy Officer who is responsible for our compliance with Canadian privacy laws. You can contact our Privacy Officer at contact@selectpro.app.
- Transfers outside Canada: your personal information will be stored and processed outside Canada, including in New Zealand, the United States and the European Union, and may be subject to access by the governments, courts and law enforcement or regulatory agencies of those countries under their laws. If you are in Quebec, this also constitutes notice that your personal information may be communicated outside Quebec.
- Electronic messages: we comply with Canada's Anti-Spam Legislation (CASL). We will only send you commercial electronic messages with your express consent or where we have implied consent under CASL, and every such message includes an unsubscribe mechanism.
- Your rights: you have the right to access and correct your personal information, and (where applicable, including under Quebec law) to request that we cease disseminating it, de-index it, or provide it to you in a structured, commonly used technological format. See the Accessing and Correcting section.
- Complaints: if you are not satisfied with how we have handled your personal information or a request, you may complain to the Office of the Privacy Commissioner of Canada at www.priv.gc.ca or, if you are in Quebec, to the Commission d'accès à l'information du Québec.
Additional Information for Individuals in the United States
If you are in the United States, this section applies in addition to the rest of this policy. SelectPro is a business-to-business service, and much of the personal information we handle relates to individuals acting in a business capacity.
- Categories of information: in the past 12 months we have collected the categories of personal information described in this policy, namely identifiers and contact details (such as name, email address, employer and job title), account and commercial information (such as subscription and billing records), internet and device activity (such as pages visited, analytics data, session recordings and error logs, including IP address), and any other information you choose to provide to us. We collect it from the sources, and use and disclose it for the purposes, described above.
- No sale or sharing: we do not sell your personal information, and we do not share it for cross-context behavioural advertising. We have not done so in the past 12 months. Aggregated and anonymised data that we derive from platform data is de-identified and is not personal information.
- Sensitive information: we do not collect sensitive personal information (as defined by applicable state law) other than account login credentials, which we use only to provide SelectPro.
- Your rights: depending on the state in which you live, you may have the right to know what personal information we hold about you and how we use it, to access it, to correct it, to delete it, to obtain a portable copy of it, and to not be discriminated against for exercising these rights. You may exercise these rights, or authorise an agent to do so on your behalf, by emailing us at contact@selectpro.app. We will verify your identity before acting on a request. If we decline your request, we will tell you why, and you may appeal our decision by replying to our response.
- Children: our website and SelectPro are not directed at children under 13, and we do not knowingly collect personal information from them. If you believe a child has provided us with personal information, please contact us and we will delete it.
Complaints
If you have a concern or complaint about how we have handled your personal information, please contact our Privacy Officer at contact@selectpro.app with details of your concern. We will acknowledge your complaint promptly, investigate it, and respond to you in writing, normally within 30 days. If you are not satisfied with our response, you may refer your complaint to the Office of the Privacy Commissioner in New Zealand (www.privacy.org.nz) or to the regulator for your country identified in the country-specific sections above.
